Child support orders are based upon the Statewide Uniform Guideline, Family Code §4050, et seq. Child support is primarily based on a comparison of incomes and the amount of time the children are with each parent. This is called the custody timeshare. Child support can be regularly updated and changed as the parents' incomes change. In many cases, this happens every two years. The Department of Child Support Services (DCSS) is now involved in the majority of child support settings and enforcement proceedings. DCSS acts in the public interest and does not represent either parent, although it tends to advocate for the interests of the child support recipient.
